1. Acceptance of Terms

By accessing the Site, creating an account, placing an order, or enrolling in a subscription, you acknowledge that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy and Refund Policy, which are incorporated by reference.

You must be at least 18 years of age to purchase from the Site. By placing an order, you represent and warrant that you are 18 years or older and have the legal capacity to enter into a binding contract.

2. Products and Services

Liberty Ark offers a mix of digital and physical products, including:

• Digital guides, blueprints, and e-books (delivered by email download links);
• Physical books and printed materials (shipped by our fulfillment partner);
• Dietary supplements and wellness products (shipped by our fulfillment partner);
• Monthly subscription boxes of dietary supplements.

Product descriptions, images, and specifications are provided for general information only. We reserve the right to modify, correct, or withdraw any product or feature at any time without prior notice. We use reasonable efforts to ensure accuracy but do not warrant that descriptions, pricing, or other content on the Site are complete, error-free, or current at all times.

3. Orders, Pricing, and Payment

3.1 Order Acceptance. All orders placed on the Site are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unavailability, errors in pricing or product information, or violation of these Terms.

3.2 Pricing. All prices are listed in U.S. dollars and are exclusive of applicable sales tax, which will be calculated at checkout. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time you complete checkout.

3.3 Payment. We accept major credit and debit cards as indicated at checkout. By submitting payment information you authorize us, or our payment processor, to charge your payment method for the total amount of your order, including taxes and shipping.

3.4 Billing Address and Shipping Address. You are responsible for providing accurate billing and shipping information. Orders with mismatched or invalid addresses may be delayed or cancelled.

4. Subscription Terms (Survival Wellness Box and Other Recurring Products)

Certain products, including the Survival Wellness Box, are offered on a recurring-charge subscription basis. By enrolling in any subscription, you explicitly authorize Dark Magus, LLC to charge your payment method on the recurring schedule disclosed at the time of enrollment. Specifically:

• Initial charge: charged at the time of order placement. For the Survival Wellness Box, the initial charge is shipping only ($29.95), with the first box shipping free of product cost.
• Recurring charges: subsequent months are charged automatically every 30 days from the date of initial enrollment, at the applicable subscription price disclosed at checkout ($178.95 per month for the Survival Wellness Box, including product and shipping).
• Payment method on file: the payment method provided at initial enrollment will be used for all recurring charges unless you update it.
• Cancellation: you may cancel your subscription at any time by emailing support@libertyarksurvival.com. Cancellations received before the next scheduled billing date will prevent the next charge. Cancellations received after a rebill has processed will apply to the subsequent cycle.
• No pro-rated refunds: once a month has been charged and the product has shipped, that month is not refundable on a pro-rated basis. Full refunds on shipped product are governed by our Refund Policy.

5. Shipping and Delivery

5.1 Processing. Physical orders are typically processed within 1–3 business days. Digital products are delivered by email download link immediately after purchase.

5.2 Carriers. U.S. shipments are sent through standard commercial carriers (USPS, UPS, FedEx, or their partners).

5.3 Shipping Destinations. We currently ship to addresses within the United States. International shipping availability is limited; see checkout for available destinations.

5.4 Risk of Loss. Title and risk of loss pass to you upon our delivery of the products to the carrier.

5.5 Delays. Delivery dates are estimates. We are not liable for delays caused by carriers, weather, customs, or events outside our reasonable control.

6. Returns and Refunds

All returns and refunds are handled in accordance with our Refund Policy, which is incorporated by reference into these Terms. Summary:

• We offer a 60-day money-back guarantee on all physical supplement products.
• Digital products (guides, blueprints, e-books) are non-refundable once downloaded.
• Refund requests must be submitted to support@libertyarksurvival.com within the applicable return window.

7. Health Disclaimer and Medical Advice

Our products are dietary supplements and informational materials. They are not medical devices, pharmaceutical drugs, or substitutes for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified healthcare provider before starting any supplement regimen, especially if you are pregnant, nursing, taking medication, or have a medical condition.

Individual results vary. Testimonials and reviews reflect the experiences of specific customers and are not a guarantee of results for everyone.

8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, audio, video, software, and downloadable materials, is the property of Dark Magus, LLC or its licensors and is protected by U.S. and international intellectual property laws.

You are granted a limited, personal, non-transferable, non-exclusive license to access the Site and to use digital products you purchase for your personal, non-commercial use. You may not copy, reproduce, distribute, publicly display, sell, lease, or create derivative works from any content or product without our prior written consent.

9. User Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to access the Site’s administrative interfaces, source code, or systems without authorization;
• Interfere with the Site’s functionality, security, or other users’ access;
• Submit false, misleading, or fraudulent information at checkout or in communications with us;
• Reverse-engineer, decompile, or circumvent any technical protections on digital products;
• Resell any digital product or distribute it in violation of the license granted in Section 8.

10. Third-Party Links and Content

The Site may contain links to third-party websites or services. We do not control and are not responsible for the content, policies, or practices of those third parties. Your use of third-party websites is at your own risk.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED.

WE MAKE NO GUARANTEE REGARDING THE EFFECTIVENESS, SUITABILITY, OR RESULTS OF ANY DIETARY SUPPLEMENT, INFORMATIONAL PRODUCT, OR OTHER PRODUCT SOLD THROUGH THE SITE. INDIVIDUAL RESULTS VARY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DARK MAGUS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT, WHETHER IN CONTRACT, TORT, OR OTHERWISE, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to defend, indemnify, and hold harmless Dark Magus, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party right.

14. Governing Law and Dispute Resolution

14.1 Governing Law. These Terms and any dispute arising out of them are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles.

14.2 Informal Resolution. Before filing any formal dispute, you agree to contact us at support@libertyarksurvival.com and allow us thirty (30) days to attempt a good-faith resolution.

14.3 Binding Arbitration. Any dispute that cannot be resolved informally will be resolved through final and binding arbitration administered in Sheridan, Wyoming under the Commercial Arbitration Rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

14.4 Class Action Waiver. You agree that any dispute will be brought only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

14.5 Small Claims Exception. Either party may bring an individual action in small-claims court instead of arbitration.

15. Changes to These Terms

We may modify these Terms at any time by posting a revised version on this page with a new “Last Updated” date. Material changes will be communicated by email when practicable. Your continued use of the Site or placement of a new order after changes take effect constitutes acceptance of the revised Terms.

16. Entire Agreement and Severability

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Dark Magus, LLC regarding the Site and your purchases. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
